En la actualidad, nuestros derechos se encuentran consagrados en la Constitución Política de los Estados Unidos Mexicanos, así como en los Tratados Internacionales que regulan los Derechos Humanos.
¿Qué son los Derechos Humanos?
Son las atribuciones que por Ley Natural y Ley Divina han conferido al Ser Humano, y que radican en nuestra propia naturaleza. Por eso, ni los Legisladores, ni cualquier otra autoridad, pueden crear Derechos Humanos, porque eso ya está escritos desde que se creó la Naturaleza; y protegen al Ser Humano desde que está en el vientre de su madre (feto), al nacer y hasta que muera. Lo único que pueden hacer los legisladores, es Reconocer Los Derechos Humanos que ya existen desde que habitó este planeta el primer ser humano.
¿Qué relación tienen los Derechos Humanos con las Empresas?
Tiene total relación, pues los Derechos de los Empresarios y el Derecho de las Empresas son también parte integrante de los Derechos Humanos.
Por consiguiente, el Empresario tiene el Derecho Humano de Crecer como Empresario y Gozar del éxito como tal en base a un principio de Derecho denominado “Principio de Progresividad de los Derechos Humanos”, el cual tiene su sustento en la Jurisprudencia cuyo rubro dice: PRINCIPIO DE PROGRESIVIDAD DE LOS DERECHOS HUMANOS. SU NATURALEZA Y FUNCIÓN EN EL ESTADO MEXICANO, registrada bajo la Época: Décima Época, Registro: 2019325, Instancia: Segunda Sala, Fuente: Gaceta del Semanario Judicial de la Federación, Libro 63, Febrero de 2019, Tomo I, Materia(s): Constitucional, Común, Tesis: 2a./J. 35/2019 (10a.), Página: 980.
Así mismo, el Máximo Tribunal de nuestro país, con sustento en el Principio de Derecho de Interpretación más Favorable a la persona, reconoció a las Empresas tener sus propios Derechos Humanos, con independencia de los Derechos Humanos de sus socios o accionistas; todo en base a la jurisprudencia cuyo rubro dice: PRINCIPIO DE INTERPRETACIÓN MÁS FAVORABLE A LA PERSONA. ES APLICABLE RESPECTO DE LAS NORMAS RELATIVAS A LOS DERECHOS HUMANOS DE LOS QUE SEAN TITULARES LAS PERSONAS MORALES, registrada bajo la Época: Décima Época, Registro: 2008584, Instancia: Pleno, Tipo de Tesis: Jurisprudencia, Fuente: Gaceta del Semanario Judicial de la Federación, Libro 16, Marzo de 2015, Tomo I, Materia(s): Constitucional, Tesis: P./J. 1/2015 (10a.), Página: 117.

Likewise, the Highest Court of our country, based on the Principle of Right of Interpretation Most Favorable to the person, recognized Companies as having their own Human Rights, independently of the Human Rights of their partners or shareholders; all based on jurisprudence whose heading says: PRINCIPLE OF INTERPRETATION MOST FAVORABLE TO THE PERSON.
